This "MediaZone Gets You In To Wimbledon" Sweepstakes ("Sweepstakes") is sponsored by MediaZone, Inc. San Carlos, California 94070 (herein referred to as the "Sponsor").
1. TO ENTER. Sweepstakes participation is open only to legal residents of the United States who are 21 years of age or older at the time of entry. The Sweepstakes begins 12:01 AM Pacific Time ("PT") on May 1, 2008 and ends 11:59 PM PT on June 8, 2008 ("Entry Period"). To enter online, go to www.mediazone.com/getsyouin/wimbledon and complete the official online entry form including your full name, complete address, telephone number, email address and date of birth. Send your entry by clicking on the submit button on the Sweepstakes page. Limit one entry per email address. To enter by mail, hand print the above information on a plain 3" x 5" card and mail to: "MediaZone Gets You In To Wimbledon" Sweepstakes, P.O. Box 3004, JAF Station, New York, NY 10116. Group and mechanically reproduced entries, including photocopies, are not eligible. Sponsor will not be responsible for late, lost, illegible, mutilated, incomplete, misdirected or postage due entries. All electronic entries must be received by 11:59 PM PT June 8, 2008. All mail-in entries must be postmarked by June 8, 2008 and received by June 13, 2008. Each entry must be mailed separately. All entries become the property of Sponsor and will not be acknowledged or returned. Void where prohibited or restricted by law. All federal, state and local laws and regulations apply. By participating in the Sweepstakes, entrants agree to opt-in to future communications from MediaZone. Entrants agree to be bound by these Official Rules, and the decision of the Sponsor and judges, which shall be final and binding in all respects.
2. PRIZES. One (1) Grand Prize will be awarded. Grand Prize winner will receive a five (5) night trip for two (2) people (that is, Grand Prize winner plus one travel companion designated by winner) to London, England from Wednesday, July 2, 2008 to Monday, July 7, 2008. Trip includes roundtrip economy-class airfare for two (2) to Heathrow Airport (or another nearby airport selected by the Sponsor) from a major airport near winner's residence, five (5) nights hotel accommodations (1 room, double occupancy) in London, two (2) tickets to the Wimbledon Championships on Sunday, July 6, 2008, roundtrip airport transfers, breakfast daily and London train passes to and from the All England Lawn Tennis Club. Grand Prize winner and travel companion must travel on the same itinerary. Winner is solely responsible for all other expenses not specified herein, including but not limited to, gratuities and hotel incidentals. Accommodation restrictions and blackout dates may apply. All travel dates and arrangements are subject to change, availability and Sponsor's selection and/or approval. Once travel is booked, no changes or cancellations will be accepted and no extensions or exceptions apply. The winner and travel companion must present valid identification prior to ticketing. Winner and travel companion are subject to the restrictions and regulations set by airline carriers, hotels, transport companies, the arena where the Wimbledon Championships will take place, and government agencies; Sponsor shall not be responsible for any decrease in the value of the prize or the unavailability to winner and/or the travel companion of all or part of the prize resulting from the application of any such restrictions and regulations. Trip may not be combined with any other offer and travel might not qualify for frequent flyer miles. Other restrictions may apply. Grand Prize winner's travel companion cannot be a minor unless winner is such minor's parent or legal guardian. Approximate Retail Value ("ARV") of Grand Prize is $21,000, but actual final value of trip may vary based on point of departure and ticket availability at time of purchase. ARV of all prizes is $21,000. No substitution or cash equivalent of prizes is permitted except at Sponsor's sole discretion. If for any reason the Grand Prize winner cannot or does not accept all or any portion of the prize as presented, the prize or such portion of the prize shall be forfeited. In the event the initially designated Grand Prize winner is for any reason disqualified or will not or does not travel to London as part of the prize, the travel companion designated by such initially designated winner shall not be permitted to participate in any portion of the prize (and any tickets or other items making up the prize that may already be in such travel companion's possession must be returned to Sponsor). Winner is responsible for any and all federal, state and local taxes or assessments and any person winning over $600.00 in prizes will receive an IRS Form 1099 from Sponsor for the calendar year in which the prize is awarded. Odds of winning depend on the number of eligible entries received.
3. RANDOM DRAWING. Potential winner will be chosen in a random drawing to be held on or about June 13, 2008 from among all eligible entries received by an independent judging organization whose decision with respect to the selection of the winners and the interpretation of these rules and regulations will be final. Winner need not be present to win. Winner will be notified by telephone, email or U.S. mail. Grand Prize winner and travel companion will be required to sign and return an Affidavit of Eligibility, Release and Indemnification and a Publicity Release (where allowed by law) within five (5) business days after winner receives such document(s). The winner's traveling companion will also be required to sign and return an Affidavit of Eligibility, Release and Indemnification and a Publicity Release (where allowed by law) within five (5) days after winner receives such document(s).and will otherwise be ineligible to participate in the prize. If potential winner does not reply to such notification within five (5) business days, an email notification is undeliverable after up to three (3) attempts and/or the Affidavit of Eligibility, release and Indemnification and Publicity Release is not returned to Sponsor within specified time period, winner will be disqualified and an alternate winner will be selected.
In the event of any dispute concerning the identity of any entrant of an online entry, the entry will be deemed submitted by the natural person who is the authorized holder of the transmitting email account. Sponsor and its agencies are not responsible for notifications that are misdirected because of email addresses that are no longer correct, or for any other reason beyond the control of the Sponsor. Return of any prize notification as "undeliverable" will result in disqualification. If for any reason any prize is not claimed or a winner is disqualified, the prize will be forfeited and an alternate winner will be selected from among all eligible entries received during the Entry Period.
4. GENERAL RULES. Employees of MediaZone, Inc. and their respective subsidiaries, affiliates, advertising, promotion or fulfillment agencies, and any of their affiliated companies, agents, assigns and suppliers, and their immediate families and members of household (whether or not related) are not eligible to enter or win. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.
By acceptance of the benefit of prize, winner and winner's travel companion grant permission to the Sponsor and its agencies to use the winner's and winner's travel companion's name, city, state, and likeness for purposes of advertising, promotions, and trade without further compensation, except where prohibited by law. By entering Sweepstakes and /or accepting the benefit of prize, winner, winner's travel companion and each entrant agree to release, discharge and hold harmless Sponsor and their parent, subsidiary and affiliated companies, advertising and promotional agencies and prize suppliers and their respective officers, directors, employees, agents, attorneys and representatives (collectively, the "Sweepstakes Entities") from any and all injuries, loss, claims or damages arising out of participation in the Sweepstakes and/or acceptance or use or misuse of any prize. Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage. No transfer or substitution of prize is permitted except by Sponsor. Winner is responsible for any and all federal, state and local taxes.
If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion, to cancel, terminate, modify and/or suspend the Sweepstakes and to disqualify any individual who tampers with the entry process, violates these official rules, or acts in a disruptive manner. Any attempt by an entrant to deliberately damage any website involved in the Sweepstakes or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and/or civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages, including attorneys' fees, from any such entrant to the fullest extent of the law, including criminal prosecution, No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries; or any problems or technical malfunctions of any telephone network or lines, typographical or other errors, computer online systems, servers or providers, computer equipment, software, failure of any email or electronic entry to be received on account of technical problems or traffic congestion on the Internet or on any website or any combination thereof, including any injury or damage to participant's or any other person's computer related to, or resulting from, participation in or down loading any materials from this Sweepstakes. By participating in this Sweepstakes and/or accepting the benefit of prize, entrants, winner and winner's travel companion agree to be bound by these Official Rules and the decisions of the Sponsor and the judges, which shall be final in all respects. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes, or in the announcement of the prizes. Sponsor reserves the right, at its sole discretion, to disqualify any individual it determines to be tampering with the entry mechanism, to be violating these Official Rules or to be acting in a disruptive manner.
5. HOLD HARMLESS. Sweepstakes provided "as is". Winner, winner's travel companion and each entrant agree that the Sweepstakes Entities shall not be responsible or liable for, and winner, winner's travel companion and each entrant agree to release and hold harmless the Sweepstakes Entities from losses, damages, or injuries of any kind to person, including personal injury or death, or property resulting from participating in the Sweepstakes or Sweepstakes-related activity, including , but not limited to, the acceptance/possession and/or use or misuse of any prize or any injury or damage to entrant's or third person's property related to or resulting from any prize or any part of the Sweepstakes. By participating in the Sweepstakes and/or accepting the benefit of prize, winner, winner's travel companion and each entrant agree that the Sweepstakes Entities will have no liability whatsoever for, and that entrant shall hold the Sweepstakes Entities harmless against, any liability for any claims based on publicity rights, defamation, or invasion of privacy. By participating in the Sweepstakes and/or accepting the benefit of prize, winner, winner's travel companion and each entrant agree that injuries, damages, or losses of any kind, whether or not foreseeable, including, without limitation, direct, indirect, incidental, consequential or punitive damages to persons, including death, or to property arising out of the internet website used in the Sweepstakes, the prize or any trip awarded hereunder.
Without limiting the foregoing, everything regarding the Sweepstakes, including any websites used in connection therewith and any prize awarded hereunder, are provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement, all of which are expressly disclaimed by the Sweepstakes Entities.
